    About Conducting Investigations in New Mexico

    New Mexico is one of the most beautiful states I’ve seen. The Sangre de Christo mountains run along the center of the state and Albuquerque sits just west of the Sandia Mountains, named for the distinctive watermelon color that the mountains display in the setting sun. The Rio Grande River runs through the state as it makes it’s way from the headwaters in Colorado to the Gulf of Mexico.  Gone are the days when you’d get asked about living “outside the U.S.”, but most people who haven’t spent much time here can’t be expected to know that this is the Lower 48’s least densely-populated state. The state’s  southern border is also the border with Mexico. We also have a very diverse population, including a large Hispanic population that traces their roots back to the days of the Spanish land grants, as well as much of the land being Native American reservation and pueblo lands, with sovereign governments under B.I.A. (Bureau of Indian Affairs) administration or tribal government.


        The geography is also diverse and many times rugged as well. Hundreds of small communities run along the river valleys and through the mountains, each with it’s own distinct character and flavor. The southeastern region of the state most resembles West Texas, geographically and culturally. The rest of the state is unmistakably, New Mexico.

        The nature of the geography, local traditions, and different governmental structures can present challenges in working here. In addition to understanding state law, an investigator needs to be able to assimilate and understand the particular areas and their unique differences to be effective. Just as it’s important to know the local areas, working with tribal governments takes experience and local area knowledge. Tribal governments are sovereign entities and thus their legal systems must be respected to be effective. You can forget state law when you’re “on the res”, it takes tact and respect to be effective. The Native Americans are a  particularly under-served group. I have been fortunate to have worked with Native peoples both on and off the reservation/ pueblos and was recently involved in a custodial fitness investigation which was the first case of its’ type under their legal system.
